Terms of Service

These terms govern your use of Fixalo (“the service”). Creating an account or using the service means you agree to them. If you don’t, don’t use it.

The service

Fixalo provides an AI voice receptionist that answers inbound calls, captures leads, and (with your authorization) interacts with QuickBooks Online and Google Calendar on your behalf.

Your account

  • You’re responsible for keeping your sign-in email and any access tokens secure.
  • You agree to give us accurate information at signup and keep it current.
  • You must be authorized to act on behalf of the business you list.
  • You won’t share an account between businesses.

Acceptable use

You won’t use Fixalo to:

  • Make outbound calls to people who haven’t consented.
  • Defraud, harass, threaten, or impersonate anyone.
  • Send unlawful SMS (TCPA, CASL, or equivalent).
  • Interfere with the service’s operation, scrape it, or reverse-engineer it.
  • Resell access without our written agreement.

We can suspend or terminate accounts that violate these rules without notice if the abuse is ongoing.

Billing

  • Subscriptions are billed in advance through Stripe at the rate shown when you signed up.
  • Free trials last for the period stated at signup. Card on file is required; you’ll be charged at the end of the trial unless you cancel before it ends.
  • You can cancel any time through the customer billing portal. Cancellation stops future renewals; we don’t pro-rate the current period.
  • If a payment fails, we’ll keep the service running for a short grace period while Stripe retries. Sustained failure pauses the agent.
  • Usage-based costs (e.g., per-minute voice processing) are accrued continuously and reflected on each invoice.

Calls & recordings

The agent discloses recording at the start of every call. You agree that you have the legal right to operate a phone line at the inbound number you provide and to have inbound calls answered and recorded by an automated system. If your state or local rules require additional disclosure, you’re responsible for configuring or requesting it.

Third-party integrations

QuickBooks Online and Google Calendar (and any other integrations you connect) are governed by their own terms. Fixalo only acts within the scope you authorize. We aren’t responsible for changes those services make to their APIs or pricing.

No warranty

The service is provided “as is.” We do our best to keep it accurate and available, but we don’t guarantee that the AI will never miss a lead, mis-transcribe a number, or produce an unexpected response. You’re responsible for reviewing leads, confirming invoices before sending, and supervising what the agent does on your behalf.

Limit of liability

To the extent allowed by law, Fixalo’s total liability to you for any claim arising from the service is capped at the amount you paid us in the three months before the claim. We aren’t liable for indirect, incidental, or consequential damages (including lost revenue or missed jobs).

Termination

You can stop using the service and delete your account any time. We can suspend or terminate accounts for breach of these terms, fraud, unpaid invoices, or to comply with the law. On termination we keep billing records as required and delete the rest within 30 days unless you ask us to retain them.

Changes

We’ll update the “Last updated” date above and, for material changes, email account holders. Continued use after a change means you accept the new terms.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Disputes are resolved in the state or federal courts located in Orange County, California, and you consent to that jurisdiction.
